Your car can be totaled based on paint quality?

So, last night I found this Craigslist ad... Apparently, and the pictures do support the story, this car was keyed by an angry girlfriend. Now, we don't have the whole story there, so please no bashing this girl here; this is about the car. Apparently, the insurance company totaled it after the incident and it has a salvage title now. Because of the paint. Is that even a real thing?

Sure. If the cost to fix the car is more than the car is deemed to be worth, it gets totaled out, for whatever reason. It's not uncommon for older cars to be "totaled" while still being a rather easy fix, they just then have salvage titles, which can come with insurance restrictions down the road.

It's possible, but it would be really odd for someone with a non-collectible quality old car to put in a paint claim to insurance unless they were just trying to get some quick cash in exchange for a salvage title.

Still, it seems odd that unnecessary repairs are taken into account. Unless it's due entirely to the rust that came out of this, but I'd assume that's just at the surface (and either way, the body panels aren't really structural. As long as the rust is neutralized before it reaches the frame, it's no problem).

Also, how would one go about making it street legal again? Would it require a professional paint job, or just spray-can primer over the scratches? I'm not in the market for another car, especially not one that's posted in the wrong city, but if I DID have the money and the means to have it delivered, it's a pretty solid car otherwise.

To get it to be street-legal, I think you would just have to get it to pass inspection and apply for a new title. The paint doesn't impact the car's safety, the insurance company just totaled it because it cost more to repaint than they considered the car to be worth.
